A judge of the Civil Court of the City of New York dismissed a credit card debt collection lawsuit naming CACH of Colorado LLC as the collection agency Plaintiff. The judge determined there is no such company called CACH of Colorado LLC.
It appears the debt buyer / creditor’s official legal name is CACH LLC.
Consumer credit collection agency CACH LLC and The Law Office of Kevin Z. Shine, PLLC claimed that CACH LLC purchased old credit card debt the consumer debtor had incurred with Sears department store. The Sears credit card account had allegedly been assigned to Citibank South Dakota, N.A., and later transferred to Citibank, N.A. before CACH bought the debt.
The Law Office of Kevin Z. Shine filed a motion on behalf of debt collectors CACH / CACH of Colorado asking to Amend the lawsuit Summons and legal caption of the Complaint, to remove CACH of Colorado LLC and change the name of the Plaintiff to CACH LLC.
The judge denied the debt collector’s motion, noting that the collection agency CACH LLC / CACH of Colorado LLC was not properly registered with the New York State Secretary of State and had made the same mistake with hundreds of prior debt collection lawsuit filings.
The judge was not satisfied that the witness from CACH LLC / CACH of Colorado LLC had adequate legal knowledge about the consumer credit card account at issue, specifically the creation of the credit account by Sears, the assignment of the credit account by Sears to Citibank South Dakota, N.A., and the transfer of the account from Citibank South Dakota, N.A. to Citibank, N.A., let alone the alleged sale of the defaulted and charged off credit account from Citibank to CACH LLC / CACH of Colorado LLC.
